UA Alums Involved in Effort to Legally Prosecute Non-Indians on Pascua Yaqui Tribe

University of Arizona alumnus Alfred Urbina, chief prosecutor for Southern Arizona's Pascua Yaqui tribe, has sat in front of families whose loved ones have been victims of violent crimes, only to say there is nothing that can be done.

"I have had to face whole families and explain that we could not provide the full measure of justice that their loved ones deserved," he says. "I have watched mothers and grandmothers cry and I could do little to help them."

The Bay Mills Case: An Opportunity for Native Nations

On May 27th, the U.S. Supreme Court finally handed down its decision in the Michigan v. Bay Mills Indian Community case. The good news for Native nations is that the Court upheld the doctrine of tribal sovereign immunity, opting not to carry out any of the doomsday scenarios many suggested could occur. The bad news is that the doctrine of tribal sovereign immunity remains vulnerable to attack by potential future Supreme Court decisions and/or Congressional action. Fortunately, the durability of this vital tool of tribal sovereignty depends to a significant degree on what Native nations do from this point forward...

A 'historic day' at pueblo

Secretary of Interior Ken Salazar called it a “historic day” as he signed regulations at Sandia Pueblo on Thursday morning that will allow the tribe to lease land without federal approval.

The pueblo is only the second tribe in the country to take advantage of a law, called the HEARTH Act (Helping Expedite and Advance Responsible Tribal Home Ownership Act of 2012), which was signed last year. Open Mike: Feds, Yakamas make historic pact

Reporter Phil Ferolito joins Mike Faulk on Open Mike this week to discuss a recent pact between the U.S. Department of Justice and the Yakama Nation to notify tribal police before executing search and arrest warrants.

The move could help widen the path for the Yakama Nation, a sovereign nation, to have its full civil and criminal authority over its people returned.

Benton and Yakima counties have already agreed to not only allow a tribal police officer to be present when executing such warrants, but also to book tribal suspects into the tribe’s jail and go through an extradition process...
